Seller's Disclosure Form
The disclosure form is a detailed list of what the Seller knows about the condition of the property. It informs the buyer so the buyer knows what they are buying.
The form is best provided to buyers before they make an offer. Often, a copy is uploaded to the MLS for easy download by agents representing buyers.
Some sellers feel like they should downplay problems so as not to scare away buyers. Instead, sellers should fully inform the buyers. This protects the buyer - they know what they are buying. It also protects the seller - they told the buyer what they knew about the property.
As a seller, when in doubt - give more detail, not less. As a buyer, when in doubt - ask for more details.
The Brokerage should not fill out any portion of the Seller Disclosure except the property address, which is often filled in by forms software.
